Terms of Service

1. Acceptance of terms

By accessing or using a11y lint ("the Service") at a11y-lint.com or app.a11y-lint.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.

2. Description of service

a11y lint provides an automated web accessibility auditing platform that scans web pages using axe-core and AI analysis to identify potential WCAG 2.2 violations and accessibility barriers. The Service generates reports containing accessibility findings, severity ratings, and suggested remediation guidance.

2.1 No compliance guarantee

Automated accessibility testing can reliably detect a portion of WCAG 2.2 failures. The Service is a tool to assist with accessibility improvement — it does not guarantee legal compliance with the Americans with Disabilities Act (ADA), Section 508, EN 301 549, or any other accessibility law or regulation. Full compliance requires manual testing, real assistive technology testing, and expert review. a11y lint expressly disclaims any guarantee of legal compliance.

3. Accounts and organizations

You must create an account and verify your email address to use the Service. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the security of your password and account credentials.
• All activity that occurs under your account.
• Promptly notifying us of any unauthorized use of your account at support@a11y-lint.com.

Each account is personal. You may not share account credentials with others. Each team member should have their own account.

3.1 Organizations

When you create an organization, you become the Owner. Owners may invite other users to join the organization with Admin or Member roles. You are responsible for managing your organization members and ensuring that all members comply with these Terms.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit URLs for scanning without authorization from the website owner (you must own or have explicit permission to test the target website).
• Use the Service to scan websites in a manner that causes denial-of-service or disruption to the target site.
• Attempt to gain unauthorized access to any part of the Service, its infrastructure, or other users' accounts.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use automated means to scrape, crawl, or extract data from the Service beyond normal use.
• Resell or sublicense access to the Service without our written consent.
• Use the Service to store or transmit malicious code, viruses, or harmful data.
• Violate any applicable local, national, or international law or regulation.

We reserve the right to suspend or terminate accounts that violate this section without refund.

5. Billing and payment

5.1 Subscription plans

The Service is offered on a subscription basis. Plan details (audit limits, seat counts, features) are described at a11y-lint.com/#pricing. We reserve the right to modify plan features with 30 days' notice.

5.2 Payment

Paid subscriptions are billed in advance on a monthly or annual cycle. Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for the applicable subscription fee.

5.3 Cancellation

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. We do not offer prorated refunds for partial billing periods, except where required by law.

5.4 Refunds

If you believe you have been charged in error, contact us within 14 days of the charge at support@a11y-lint.com and we will review your case.

5.5 Free plan

The Free plan is provided at no charge subject to the usage limits described on the pricing page. We reserve the right to modify or discontinue the Free plan with 30 days' notice.

5.6 Taxes

Prices are exclusive of applicable taxes. You are responsible for any sales, VAT, GST, or similar taxes applicable in your jurisdiction.

6. Intellectual property

The Service, including its software, design, trademarks, and content, is owned by a11y lint and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights in the Service.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms.

7. Your content and data

You retain all ownership rights to the URLs you submit for auditing and any data you upload to the Service ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely to provide the Service.

We do not claim ownership of Your Content. We will not share Your Content with third parties except as described in our Privacy Policy.

You represent and warrant that you have the necessary rights and permissions to submit URLs for scanning, and that doing so does not violate any third party's rights or any applicable law.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

• The Service will be uninterrupted, error-free, or available at all times.
• Audit results will be complete, accurate, or identify all accessibility issues on a given page.
• Using the Service will result in legal compliance with any accessibility standard or regulation.
• AI-generated analysis will be free from errors or hallucinations.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL a11y LINT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU IN FULL.

10. Indemnification

You agree to indemnify, defend, and hold harmless a11y lint and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service in violation of these Terms.
• Your Content or the URLs you submit for auditing.
• Your violation of any applicable law or third-party rights.

11. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your access to the Service immediately, without notice, if you breach these Terms or if we determine that your use poses a risk to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days of termination, except where retention is required by law. Sections 7 (Your Content), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Governing Law) survive termination.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association.

You waive the right to participate in a class-action lawsuit or class-wide arbitration against a11y lint.

13. Changes to these Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and update the "Last updated" date. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
